Terms of Service

These Terms of Service ("Terms") govern your use of Watchi, a Telegram Mini App operated by Kenherli Digital Sociedad Limitada ("we", "us", "our"), registered in Valencia, Spain. By using the App, you agree to these Terms.

1. Service Description

Watchi is a focus timer application that runs inside Telegram. It helps you build a focus habit through timed sessions, streak tracking, stats dashboards, and AI-powered weekly insights. The App is accessed via Telegram's Mini App platform and does not require a separate account registration.

2. Eligibility

You must be at least 16 years old (or the minimum age required in your country) to use the App. By using Watchi, you confirm that you meet this age requirement and that your Telegram account complies with Telegram's Terms of Service.

3. Free and Pro Tiers

Free tier includes:

• Up to 3 focus sessions per day
• All timer features, tags, and duration settings
• Streak tracking and daily goals
• Full stats dashboard
• Morning reminders and streak-at-risk notifications

Pro tier adds:

• Unlimited focus sessions per day
• AI-powered weekly insight reports
• Streak freeze (1 per week, automatically applied)
• Full insights tab with personalized analysis

4. Payments and Subscriptions

Pro subscriptions are purchased using Telegram Stars, Telegram's in-app currency. We offer two plans:

• Monthly: 250 Stars/month with automatic renewal
• Annual: 2,500 Stars (one-time payment, non-recurring)

Auto-renewal: Monthly plans renew automatically through Telegram's subscription system. You can cancel auto-renewal at any time through Telegram's subscription management (Settings > My Stars > Subscriptions in Telegram).

Cancellation: You may cancel your subscription at any time. Upon cancellation, your Pro access continues until the end of the current billing period. After that, your account reverts to the Free tier. Your data (sessions, streaks, tags) is retained.

5. Refunds

Refund requests for Telegram Stars purchases are handled by Telegram in accordance with the policies of the platform through which you purchased Stars (Apple App Store or Google Play). We do not process refunds directly, as all payments flow through Telegram's payment infrastructure.

6. Promo Codes

We may issue promotional codes that grant free Pro access for a limited period. Promo codes are single-use, non-transferable, and cannot be exchanged for monetary value. We reserve the right to revoke promo codes that are obtained fraudulently.

7. Acceptable Use

You agree to use the App only for personal productivity purposes. You may not:

• Use automated tools, bots, or scripts to interact with the App
• Attempt to circumvent the free tier session limit or payment system
• Attempt to gain unauthorized access to other users' data
• Reverse-engineer, decompile, or attempt to extract the source code
• Use the App for any illegal purpose
• Resell, redistribute, or sublicense access to the App

We reserve the right to suspend or terminate access for users who violate these terms.

8. AI-Generated Content

The weekly insight reports are generated by artificial intelligence (OpenAI) based on your aggregated focus session data. These reports are for informational and motivational purposes only. They do not constitute professional advice (medical, psychological, or otherwise). AI-generated content may contain inaccuracies. Use your own judgment when acting on suggestions.

9. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which explains what data we collect, how we use it, and your rights under GDPR.

You can delete all your data at any time via Settings > Delete All Data within the App.

10. Availability and Modifications

We strive to keep the App available at all times, but we do not guarantee uninterrupted access. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control (Telegram platform issues, server outages).

We reserve the right to modify, update, or discontinue features of the App at any time. If we make changes that materially affect your paid subscription, we will provide reasonable notice.

11. Intellectual Property

All content, design, code, graphics, and trademarks in the App are owned by Kenherli Digital Sociedad Limitada or licensed to us. You may not copy, modify, or distribute any part of the App without our written permission.

Your focus session data belongs to you. We do not claim ownership of your personal usage data.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "as is" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, accuracy, or uninterrupted availability.
• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data, loss of productivity, or loss of revenue.
• Our total liability for any claim related to the App shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms excludes liability for fraud, gross negligence, death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.

13. Indemnification

You agree to indemnify and hold harmless Kenherli Digital Sociedad Limitada from any claims, damages, losses, or expenses arising from your violation of these Terms or your misuse of the App.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Spain. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Valencia, Spain.

If you are a consumer resident in the European Union, you also have the right to submit a dispute to the EU Online Dispute Resolution platform.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via the App or through a Telegram message. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
